Using Spell Five — subscribing, opening a puzzle, tapping an answer — means you accept what is on this page. If you do not, please do not use the service. Spell Five is published from 58 US Hwy 46, Budd Lake, NJ 07828.
You must be 18 or older and a legal resident of the fifty United States or the District of Columbia. One person, one subscription. You are responsible for the email address you give us and for anything done through it.
Every email we send carries a link unique to you. It is how the site knows whose entry an answer belongs to, and it works without a password — so treat it as private. Do not forward, publish or share it. Answers recorded through your link count as yours, and we may void entries where a link has plainly been shared or automated.
These void entries and can close an account: automated or scripted play, more than one subscription controlled by one person, disposable or generated addresses used to multiply entries, interfering with the site, and any other attempt to manufacture entries. We decide this reasonably and our decision is final.
The prize, the entry period, the odds, how a winner is chosen and how a prize is claimed are all set out in the Official Rules. Nothing here changes them. No purchase is necessary and buying nothing improves your chances, because there is nothing to buy.
The puzzles, clues, grids, wordlists, copy and design are ours. Play them, enjoy them, tell people about them. Do not republish, scrape, resell or build a competing product from them without written permission.
Subscribing means agreeing to receive the daily puzzle and, if you ask for them, bonus rounds and the Monday winner announcement. Every email carries an unsubscribe link and it works immediately. Unsubscribing is free and never affects entries already recorded for the period you are in.
The service is provided as it is. We try to send a puzzle every morning and to keep the site up, and we do not promise either. Email delivery in particular depends on providers we do not control. A day with no puzzle is not a breach of these terms.
To the extent the law allows: Spell Five is not liable for indirect, incidental, special or consequential loss arising from the service, including a missed email, a missed entry or an interrupted drawing. Our total liability for any claim connected with the service is limited to the value of the prize for the period the claim relates to. Nothing here limits liability that cannot lawfully be limited.
If your misuse of the service causes a claim against us — automated entry, a shared play link, content you send us — you agree to cover the reasonable costs of dealing with it.
You can stop at any time by unsubscribing. We can suspend or close an account that breaks these terms, and we can end the service entirely. If we end it mid-period, any drawing already open is completed under the Official Rules or the prize is awarded from the entries received before it stopped.
What we collect and what we do with it is set out in the Privacy Policy. In short: an email address, a first name, and what you tapped. We do not sell it.
We may change these terms. The date at the top says when they last changed, and anything material will be said in the newsletter. Continuing to play after a change means accepting it.
These terms are governed by the laws of the State of New Jersey, without regard to conflict of law rules. Any dispute goes to the state or federal courts sitting in New Jersey, and you agree to that venue.
If a court finds part of these terms unenforceable, the rest stands. Not enforcing something once does not waive it. These terms and the documents they link to are the whole agreement between us about the service.
